The proposed Code of Practice for marriage officiants in Ontario\u2019s Bill 213 has been abandoned.<\/p>\n\n\n\n

In late October<\/a> we talked about the Marriage Act<\/a><\/em> and Bill 213. It would have added a Code of Practice and modified the terms on which the government minister could cancel the registration of a person authorized to solemnize marriage.<\/p>\n\n\n\n

On December 8,<\/a> the bill received Royal Assent (Royal Assent<\/a> means that the bill has been passed by the Legislative Assembly, is signed by the Lieutenant Governor, and has become a statute. In other words, it is no longer a bill but a law).<\/p>\n\n\n\n

If you look at the final version of the bill<\/a>, you will see that there is no mention of the Marriage Act<\/em>. What happened? The committee reviewing the bill struck out<\/a> \u2013 that is, erased \u2013 all of the proposed amendments to the Marriage Act.<\/em> The committee\u2019s amendments were accepted when the bill was passed. That means they were not<\/em> part of the bill when it became law. That\u2019s a positive outcome.<\/p>\n\n\n\n

But let\u2019s take just a moment to reflect on comments made in debate at third reading<\/a> which took place the committee made its amendments. During debate it was argued that a Code of Practice would have simply required officiants to \u201cadhere to\u201d or uphold the Ontario Human Rights Code<\/a> <\/em>(HRC<\/em>) and that target of the Code of Practice was \u201c\u2019fly-by-night\u2019 marriage officiants\u201d who had allegedly \u201cbeen denying to oversee a same-sex marriage.\u201d<\/p>\n\n\n\n

There are a few issues here. First, the HRC<\/em> does indeed already protect against discrimination in services<\/a> on the grounds of sexual orientation. We have a HRC <\/em>to receive, review and remedy complaints of discrimination. A Code of Practice is therefore redundant.<\/p>\n\n\n\n

Second, if that was the intention behind Code of Practice, there\u2019s a very real likelihood it would, itself, violate the HRC<\/em>. Why? The HRC<\/em> specifically allows<\/a> a person to decline solemnizing a marriage if it\u2019s contrary to that person\u2019s religious beliefs, and if that person is registered as part of a religious body<\/a> or by the (government) Minister<\/a>.<\/p>\n\n\n\n

Third, with the exception of reference to the \u201cfly-by-night\u201d officiants, there was no apparent reason as to why the amendments were proposed; there was no identifiable or pressing concern that would be addressed.<\/p>\n\n\n\n

In the end, it seems that the amendments were viewed as redundant \u2013 existing legislation and methods are sufficient to address any concerns.<\/p>\n","protected":false},"excerpt":{"rendered":"
