This shows that collective advocacy is having an impact as Senators relayed concerns expressed to them and emphasized the need \u201c<a href=\"https:\/\/sencanada.ca\/en\/content\/sen\/chamber\/451\/debates\/068db_2026-04-28-e?language=e#:~:text=to%20reassure%20Canadians%20that%20their%20freedom%20of%20religious%20expression%20remains%20protected\">to reassure Canadians that their freedom of religious expression remains protected<\/a>.\u201d<\/p>\n\n\n\n<p>A key focus of the debate surrounded the removal of the <a href=\"https:\/\/www.canlii.org\/en\/ca\/laws\/stat\/rsc-1985-c-c-46\/latest\/rsc-1985-c-c-46.html#sec319subsec3\" target=\"_blank\" rel=\"noreferrer noopener\">good-faith religious defence<\/a> Bill C-9 creates a \u201c<a href=\"https:\/\/sencanada.ca\/en\/content\/sen\/chamber\/451\/debates\/068db_2026-04-28-e?language=e#:~:text=structural%20change%20to%20Canada%E2%80%99s%20hate%2Dpropaganda%20framework\" target=\"_blank\" rel=\"noreferrer noopener\">structural change to Canada\u2019s hate propaganda framework<\/a>\u201d \u00a0impacting the balance between protecting Canadians from hatred and safeguarding <a href=\"https:\/\/www.canlii.org\/en\/ca\/laws\/stat\/schedule-b-to-the-canada-act-1982-uk-1982-c-11\/latest\/schedule-b-to-the-canada-act-1982-uk-1982-c-11.html#:~:text=and%20democratic%20society.-,Fundamental%20Freedoms,-Fundamental%20freedoms\" target=\"_blank\" rel=\"noreferrer noopener\">freedom of religion and expression.<\/a><\/p>\n\n\n\n<p>The good-faith religious defence was intended to provide clarity in both protecting fundamental freedoms and applying the law. Removing it creates a chilling effect that may infringe constitutionally protected freedoms.<\/p>\n\n\n\n<p>\u2026. by removing the good-faith religious expression defence, Bill&nbsp;C-9 introduces a greater degree of legal ambiguity. It leaves more to interpretation&nbsp;\u2014 by police officers deciding whether to investigate, by prosecutors determining whether to lay criminal charges and, ultimately, by judges tasked with interpreting the law&nbsp;\u2014 about where the line is drawn between lawful expression and criminal conduct.<\/p>\n\n\n\n<p>Senators were also critical of the \u201c<a href=\"https:\/\/www.parl.ca\/DocumentViewer\/en\/45-1\/bill\/C-9\/third-reading#:~:text=of%20that%20fact.-,Clarification,not%20wilfully%20promote%20antisemitism%20by%20condoning%2C%20denying%20or%20downplaying%20the%20Holocaust.,-Coming%20into%20Force\" target=\"_blank\" rel=\"noreferrer noopener\">clarifying<\/a>\u201d provisions that were added to Bill C-9; \u00a0they are overly broad and do not provide <a href=\"https:\/\/sencanada.ca\/en\/content\/sen\/chamber\/451\/debates\/068db_2026-04-28-e?language=e#:~:text=the%20same%20level%20of%20certainty%2C%20clarity%20or%20confidence\" target=\"_blank\" rel=\"noreferrer noopener\">&#8220;the same level of certainty, clarity or confidence<\/a>\u201d as the good-faith religious defence.<\/p>\n\n\n\n<p>The debate also highlighted many important gaps:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Parliament should conduct a broader review of hate crimes in Canada, with the last study being 56 years ago. Trends in online hate and violence against women should be studied to assess whether current legislation is sufficient to address this type of violence.<\/li>\n\n\n\n<li>Bill C-9 should be reviewed from a constitutional lens to consider its impact on the Charter-protected rights of Canadians.<\/li>\n\n\n\n<li>While the intimidation and obstruction offences are important, they may be overbroad.<\/li>\n\n\n\n<li>More clarity is needed to justify the removal of the good-faith religious defence.<\/li>\n<\/ol>\n\n\n\n<p>Given the many constitutional concerns, Senators urged further study of\u00a0 C-9 by the Senate <a href=\"https:\/\/sencanada.ca\/en\/committees\/lcjc\/44-1\" target=\"_blank\" rel=\"noreferrer noopener\">Committee on Legal and Constitutional Affairs<\/a>.\u00a0<\/p>\n\n\n\n<p><strong>What You Can Do<\/strong><\/p>\n\n\n\n<p>If you or your organization is concerned about Bill C-9, you may wish to <a href=\"https:\/\/sencanada.ca\/en\/senators\/?v=contact\" target=\"_blank\" rel=\"noreferrer noopener\">call or write&nbsp;to a senator<\/a>. Supporters of Bill C-9 pointed to recent acts of hatred in Canada as a reason to introduce laws that address violence and discrimination.<\/p>\n\n\n\n<p>Questions came up during the debate about Bill C-9. First was how Bill C-9 would work in practice. There is uncertainty about how police and crown prosecutors would enforce Bill C-9 if it became law. Supporters recommended that a clear national strategy and guidelines exist to support fair, consistent, and effective enforcement.<\/p>\n\n\n\n<p>Another issue raised pertained to the requirement for the Attorney General\u2019s consent before certain charges can proceed. It was recommended that an independent body may be better to support judicial independence and public trust in these decisions.<\/p>\n\n\n\n<p>Further discussions on Bill C-9 included how to address hate-related offences more effectively, including pro-prosecution frameworks and offenders bearing the cost of prosecution of hate crimes when convicted. This is the stage when Senators debate bills and then usually refer them to a committee for close examination.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Good Faith Debate<\/h2>\n\n\n\n<p>During second reading, the Bill&#8217;s supporters said it would <a href=\"https:\/\/sencanada.ca\/en\/content\/sen\/chamber\/451\/debates\/062db_2026-04-14-e?language=e\" target=\"_blank\" rel=\"noreferrer noopener\">strengthen and enhance<\/a> Canada\u2019s response to hate and intimidation and noted key changes made by the House of Commons, including: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>maintaining requirement for Attorney General\u2019s consent before laying charges for propaganda offences;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>removing the good faith religious defence;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>adding a \u201cfor greater certainty\u201d clause &#8211; this was meant to clarify the law after removing the good faith religious defence;<\/li>\n<\/ul>\n\n\n\n<p>The original Bill C-9 did not remove the \u201cgood faith religious opinion defence\u201d and its removal has generated heated debate and created deep concern around freedom of expression and freedom of religion.<\/p>\n\n\n\n<p>The \u201cfor greater certainty\u201d clauses were meant to reassure the public about the scope of the hate crime offences and respond to religious communities&#8217; concerns that good faith religious expression, teaching, and discussion could be caught by the changes. The &#8220;for greater certainty&#8221; clauses state that nothing in the hate propaganda provisions:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>. . . shall be construed as prohibiting a person from communicating a statement on a matter of public interest, including an educational, religious, political or scientific statement made in the course of a discussion, publication or debate, if they do not wilfully promote hatred against an identifiable group by communicating the statement.<\/p>\n<\/blockquote>\n\n\n\n<p>CCCC has <a href=\"https:\/\/www.cccc.org\/news_blogs\/legal\/2026\/03\/09\/bill-c-9-motion-to-end-ongoing-debates\/\" target=\"_blank\" rel=\"noreferrer noopener\">previously written<\/a> about the inadequacies of the \u201cfor greater certainty\u201d clauses as currently drafted and how they do not sufficiently address the deletion of the good faith religious defence. While supporters insisted Bill C-9 would \u201c<a href=\"https:\/\/sencanada.ca\/en\/content\/sen\/chamber\/451\/debates\/062db_2026-04-14-e?language=e\" target=\"_blank\" rel=\"noreferrer noopener\">not criminalize any religious or faith-based teaching<\/a>, practice or expression not motivated by the intentional and wilful promotion of hatred\u201d, some Senators continued to raise concerns about the removal of the good faith defence. Some senators also noted how Bill C-9&#8217;s proposed changes \u201cmay <a href=\"https:\/\/sencanada.ca\/en\/content\/sen\/chamber\/451\/debates\/062db_2026-04-14-e?language=e\" target=\"_blank\" rel=\"noreferrer noopener\">deeply affect how all Canadians can exercise their core democratic rights<\/a> and that the committees that study Bill C-9 must do so in consultation with expert witnesses and civil society groups.&#8221; <\/p>\n\n\n\n<p>Debate on Bill C-9 is set to resume <a href=\"https:\/\/sencanada.ca\/en\/content\/sen\/chamber\/451\/debates\/064db_2026-04-16-e#55:~:text=stand%20adjourned%20until-,Tuesday%2C%20April%C2%A021%2C%202026,-%2C%20at%202%C2%A0p\" target=\"_blank\" rel=\"noreferrer noopener\">this week<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What You Can Do<\/h2>\n\n\n\n<p>If you or your organization have concerns, you may wish to <a href=\"https:\/\/sencanada.ca\/en\/senators\/?v=contact\" target=\"_blank\" rel=\"noreferrer noopener\">call or write&nbsp;to a senator<\/a>.
