Beginning in the early 1990s, CCCC took part in cases related to religious hiring, clergy residence deduction, private school donations, GST assessments, employment insurance, membership in religious associations, education, and religious freedom. CCCC participated in these cases primarily as an intervenor, spanning provincial human rights tribunals to the Supreme Court of Canada (SCC). Taking the clergy residence deduction case as an example, our efforts helped clarify tax regulations, ensuring thousands of clergy members across Canada could continue their vital services without undue financial burden. This is just one example of how our legal involvement directly supports and benefits the communities and members we serve.
What is an intervenor?
An intervenor brings a broader perspective to the court than the parties. An intervenor does not support one party or another or take a position on the outcome. Instead, an intervenor focuses on a particular legal issue, providing helpful and important context and views to the court that differ from the parties. Intervenors must walk a fine line between presenting something unique and helpful to the court and not expanding the case. Judges have discretion to allow or refuse interventions in any particular case, and the outcome of an application to intervene is never guaranteed.
When does CCCC intervene?
CCCC intervenes in cases that raise an issue of significant national or provincial importance, are relevant to member organizations, impact the legal and regulatory environment in which faith-based charities operate, and relate to the importance of advancing religion and other charitable purposes. We are committed to monitoring new and upcoming court cases to discern whether CCCC should intervene. We will keep you informed if and when CCCC is granted intervenor status in any future case.
CCCC Invited for Another Term with CRA's Technical Issues Working Group
We are pleased to share that CCCC has been invited back to participate in the Canada Revenue Agency's Technical Issues Working Group (TIWG) for the next two-year term. The TIWG meets to discuss forthcoming guidance and existing documents, challenges, and successes with CRA programs and platforms, and to raise emerging or long-standing issues that need attention. By having a seat at the table, we ensure that your interests and the interests of charities across Canada are voiced and considered in the crafting of policies that directly affect the mission and effectiveness of our work.
We are also pleased to be regularly invited to meetings of sector representatives, legal professionals, regulators and experts to discuss issues of significance to the charitable sector, including CRA guidance documents. These four-day meetings give time for in-depth discussions and exchange of ideas that have led to good results for the sector. In the past year, CCCC attended two consultations, including one on the new charity registration process.
