Introducing a new T3010 resource!

We are excited to announce a new enhancement to our CRA-approved resource that will make filing your charity's T3010 return even easier! Members of CCCC now have the option to download a .txt file that can be uploaded directly to CRA through My Business Account. This saves you time and reduces the chance of errors from manual entry. The resource is available free of charge for members and for a nominal ($50) annual fee for non-members. Cost of Audits and Revocation

A recent series of cases remind us that challenging revocation decisions can be complex and costly. A registered charity since 1967, the Jewish National Fund of Canada Inc. (JNF) was audited by CRA in 2014. In 2019 CRA concluded JNF failed to meet registration requirements including concerns over non-charitable purposes, insufficient direction and control, and inadequate books and records. Following a lengthy process of objections and appeals, in June 2024 the CRA confirmed its intention to revoke, which was effective in August 2024.

Four court decisions have been released regarding JNF's dispute with CRA. None of these decisions addresses JNF’s substantive arguments about the revocation. Instead, these decisions all address procedural issues, e.g., which court should hear the argument, whether arguments could be amended, and whether CRA had fully disclosed documents to JNF. 

The timeline for audit and revocation can be very slow - in this case, 10 years from audit to revocation. And, even if you file objections and appeals within the required timeframe, it does not guarantee a smooth process. All of this underscores the importance of implementing best practices and ensuring compliance with regulatory requirements. Court Challenge of Capital Gains Tax Changes

A dispute has arisen from the CRA’s decision to implement proposed capital gains tax changes, which would, among other things, raise the inclusion rate from 50% to 66.67%. The proposal is based on a Notice of Ways and Means Motion (NWMM) from September 2024 that was never ultimately passed into law before Parliament was prorogued. Despite lacking formal legislative approval, the CRA has stated its intention to follow "Parliamentary convention [which] dictates that taxation proposals are effective as soon as the government tables a [NWMM]", and treat the proposals as if they are duly passed law.

Pelco Holdings Inc. challenges this as unconstitutional, arguing it violates the rule of law, bypasses Parliament’s exclusive authority to enact tax legislation, and is contrary to CRA's own internal policy. The application seeks to halt CRA enforcement of the proposals contained in the NWMM.

This case is especially relevant to Canadian charities that rely on donations of publicly traded securities or capital property. Higher capital gains taxes could reduce the incentive for such gifts, impacting fundraising. Moreover, the CRA’s approach raises a question about legal certainty and compliance obligations for all entities, including charitable organizations navigating tax compliance and strategic asset disposition on the basis of "Parliamentary convention" rather than duly passed legislation.
