CCCC to Intervene at Supreme Court of Canada

On October 9, 2026, CCCC and the Evangelical Fellowship of Canada (“EFC”) will appear as joint intervenors before the Supreme Court of Canada (“SCC”) in the appeal of Vabuolas v. British Columbia (Information and Privacy Commissioner), 2025 BCCA 83. This case centers around religious freedom, privacy, and whether the British Columbia Information and Privacy Commissioner can compel disclosure of confidential, spiritual notes relating to matters of church membership.

CCCC and EFC’s intervention focuses on the preservation of privacy for religious decision-making. In our written arguments, we focus on three key areas:

1. Charter-protected freedom of religion protects the authority of religious communities to make religious decisions without state interference;
2. Courts generally have limited authority to intervene in the decisions of voluntary associations (including churches and Christian ministries) and courts do not have authority to determine theological matters. By extension, where records concern purely religious matters, those records should not be subject to disclosure for line-by-line review by state-appointment commissioners; and
3. Compelling the disclosure of confidential religious discussions interferes with religious governance and undermines the integrity of religious decision-making.

CCCC and EFC rely on prior SCC decisions (Wall and Aga) that affirm limits on court intervention in religious matters involving church membership and internal governance. Please pray for clarity, wisdom, and discernment as our Director of Legal Affairs prepares to appear before the SCC and present these arguments.

Christian Leadership

Hiring a Christian for a leadership role can raise important questions for faith-based charities. When can an organization require a candidate to disclose his or her Christian faith? What makes faith a bona fide occupational requirement, and how should that be reflected in a job posting or hiring process?
