In a previous post, I explored the Ontario Court of Appeal’s decision in Delicata, et al v. Incorporated Synod of the Diocese of Huron.
That case dealt with the question of ownership of charitable assets after a local church congregation parted ways with its Diocese, pursuant to “profound and long-standing theological differences.”
Yesterday, the Supreme Court of Canada dismissed an application seeking leave to appeal that decision. This leaves the Ontario Court of Appeal’s decision the final say on that matter.
